Mind-Muscle Connection, LLC (“Company” or “We”) respect your privacy and are committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide when you use the Company application (our “App“) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

• In email, text, and other electronic messages between you and this App.
• Through mobile applications or websites accessed through links or integrations within this App.
• When you interact with our advertising and applications on third-party apps and websites and services, if those applications or advertising include links to this policy.

It does not apply to information collected by:

• Us offline or through any other means, including on any other website or application operated by any third party; or
• Any third party, including through any application or content (including advertising) that may link to or be accessible from or through the App.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our App. By accessing, downloading, or using this App, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this App after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Children Under the Age of 18

Our App is not intended for children under 18 years of age. No one under age 18 may provide any personal information to or on the App. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this App or through any of its features, register on the App, make any purchases through the App, use any of the interactive or public comment features of this App, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. Information We Collect About You and How We Collect It

We collect several types of information from and about users of our App, including information:

• By which you may be personally identified, such as name, postal address, email address, telephone number, any other identifier by which you may be contacted online or offline (“personal information“);
• That is about you but individually does not identify you, such as training plans; and/or
• About your internet connection, the equipment you use to access our App, and usage details.
• Automated tracking through mobile-specific technologies such as software development kits (SDKs), pixels, local storage, device identifiers (e.g., IDFA or AAID), and other tracking tools typically used within mobile applications.
• Third-party integrations, and from mobile/app usage.

We collect this information:

• Directly from you when you provide it to us.
• Automatically as you navigate through the App. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
• From third parties, for example, our business partners and approved vendors.

Information You Provide to Us 

The information we collect on or through our App may include:

• Information that you provide by filling in forms on our App. This includes information provided at the time of registering to use our App, subscribing to our service, posting material, or requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with our App.
• Records and copies of your correspondence (including email addresses), if you contact us.
• Your responses to surveys that we might ask you to complete for research purposes.
• Details of transactions you carry out through our App and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our App.
• Your search queries on the App.
• Your use of the App in general, including pages you view.
• Identifiers (name, email), user-generated content, usage data, technical info (IP, browser), and fitness-related submissions.
• User Contribution as outlined in the Terms of Use.

You also may provide information to be published or displayed (hereinafter, “posted“) on public areas of the App, or transmitted to other users of the App or third parties (collectively, “User Contributions“). Your User Contributions are posted on and transmitted to others at your own risk. Although we may limit access to certain parts of the App as it is developed you may have certain setting which allows you to set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the App with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies 

As you navigate through and interact with our App, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

• Details of your visits to our App, including traffic data, location data, logs, and other communication data and the resources that you access and use on the App.
• Information about your mobile device and internet connection, including your IP address, operating system type and version, device manufacturer and model, mobile network information, unique device identifiers, and App version.

We also may use these technologies to collect information about your interactions with the App over time and across other mobile applications, websites, or online services for purposes such as behavioral tracking, analytics, or personalized advertising.

The information we collect automatically may include personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our App and to deliver a better and more personalized service, including by enabling us to:

• Estimate our audience size and usage patterns.
• Store information about your preferences, allowing us to customize our App according to your individual interests.
• Speed up your searches.
• Recognize you when you return to our App.

The technologies we use for this automatic data collection may include:

• Mobile Tracking Technologies. Our App may use mobile tracking technologies and local storage methods—such as secure device storage, software development kits (SDKs), and unique device identifiers—to collect information about your usage patterns and preferences. These tools help us analyze usage, improve performance, and personalize your experience. • App Pixels and Event Tags. Our App and related communications (such as push notifications or emails) may contain small data elements known as pixels, event tags, or tracking beacons. These technologies allow us to measure engagement—for example, tracking whether users have opened messages, visited specific screens, or interacted with in-app features. This information helps us improve App performance, analyze user behavior, and ensure system integrity.
• Local Storage and App Caching. Certain features of our App may rely on secure local storage mechanisms or application-level caching to retain your preferences and usage history. These tools are specific to your device and are not managed through browser settings. While this data does not typically include personal information, we may associate it with your profile or account to enhance your experience within the App.
• Device Permissions. The App may request access to certain device features or data, including your location, camera, microphone, contacts, photo library, health information, or other functions. These permissions are used solely to enable specific features of the App and are subject to your consent. You may manage or revoke these permissions at any time through your device settings. Disabling certain permissions may limit functionality.
• Location Information. With your consent, we may collect and process information about your precise or approximate location through GPS, Bluetooth, Wi-Fi signals, or cellular towers. This data may be used to support features such as localized content, matching, or analytics. You can control whether location information is shared through your device settings.
• Health and Fitness Data. If you choose to submit health or fitness-related information (such as workout history, goals, body metrics, or activity data), this data will be used solely for purposes disclosed in this Privacy Policy or the App’s features, such as personalized recommendations or performance tracking. We treat such information with enhanced care and do not use or share it for marketing unless you provide explicit consent. • Analytics Tools. We may use third-party analytics tools and SDKs to help us understand how users interact with the App. These tools collect data such as screen views, feature usage, app crashes, and in-app behavior. This data helps us improve the App’s functionality and user experience. These tools may rely on unique device identifiers, but they do not collect your name or direct contact information unless you provide it.
• Crash and Performance Reporting. To improve the stability and performance of our App, we may collect diagnostic information such as crash logs, error reports, and technical information about your device and operating system. This information is used solely to identify and resolve technical issues.

Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, on the App are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our App. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different applications and websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

• To provide you with information, products, or services that you request from us.
• To fulfill any other purpose for which you provide it.
• To provide you with notices about your account/subscription, including expiration and renewal notices.
• To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
• To notify you about changes to our App or any products or services we offer or provide though it.
• To allow you to participate in interactive features on our App.

We may also use your information to contact you about our own and third-parties’ goods and services that may be of interest to you. We may use the information we have collected from you to enable us to display in-app advertisements that are tailored to your interests or behavior. Even though we do not disclose your personal information for these purposes without your consent, if you tap on or otherwise interact with an advertisement, the advertiser may infer that you meet its targeting criteria.

Use of User Information for Fitness Features, Goals, and Challenges

By using the Application, you acknowledge and agree that the Company may collect and use certain personal information you provide—including fitness preferences, workout history, health-related inputs, activity tracking data, and user-submitted goals—for the purpose of enabling and enhancing fitness-related features offered through the platform. These features may include, but are not limited to:

• Generating personalized workout suggestions or training plans;
• Displaying fitness progress, analytics, or recommendations;
• Facilitating participation in optional fitness goals, challenges, or community-based programs;
• Matching users with Fitness Professionals or fitness groups based on activity level, preferences, or stated objectives.

Participation in any such feature is voluntary and, where required, may be subject to additional opt-in consent or user settings. You understand that the Company’s ability to provide accurate or useful fitness content depends on the completeness and accuracy of the information you submit.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this privacy policy:

• To our subsidiaries and affiliates.
• To contractors, service providers, and other third parties we use to support our business.
• To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the Company about our App users is among the assets transferred.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

• Disclosure of Your Information for Third-Party Advertising. • Promotional Offers from the Company. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience or other transactions.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s website.

Sale of Aggregate and De-Identified Data

We may use and disclose aggregated or de-identified information that does not reasonably identify you to any third party for any lawful purpose, including for research, analytics, business planning, marketing, or commercial licensing purposes. This information may be derived from your usage of the App or services, but it is not considered personal information under applicable law because it cannot reasonably be linked to you.

For users located in California: Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CPRA”), the disclosure of de-identified or aggregate information is generally not considered a “sale” of personal information. However, to the extent any of our data practices are interpreted to constitute a “sale” under California law, you have the right to opt out. Accessing and Correcting Your Information

You can review and change your personal information by logging into the App and visiting your account profile page.

You may also send us an email at contact@mind-muscleconnection.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the App, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other App users. Proper access and use of information provided on the App, including User Contributions, is governed by our terms of use.

Residents of certain states, such as California, Nevada, Colorado, Virginia, and Utah may have additional personal information rights and choices.

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Data Security

We take appropriate technical and organizational safety measures to protect your personal information. However, the security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the App like message boards. The information you share in public areas may be viewed by any user of the App.

Please note that the transmission of information over the internet or through mobile networks is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the App.

Governing Law and Jurisdiction

All matters relating to the App and this App Privacy Policy, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Florida without giving effect to any choice or conflict of law provision or rule (whether of the State of Florida or any other jurisdiction).

Without reducing the obligation to arbitrate disputes, any legal suit, action, or proceeding arising out of, or related to, this Privacy Policy or the App shall be instituted exclusively in the federal courts of the United States or the courts of the State of Florida, in each case located in the City of Orlando and County of Orange, although we retain the right to bring any suit, action, or proceeding against you for breach of this Privacy Policy in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Arbitration

Any dispute, controversy, or claim arising out of or relating to this Privacy Policy, or your use of the App, including disputes concerning their interpretation, breach, validity, performance, or termination, shall be resolved by final and binding arbitration administered by the American Arbitration Association in accordance with its Rules of Arbitration. The arbitration shall be conducted by a single arbitrator in Orlando, Florida, and the proceedings shall be confidential. The arbitrator shall apply the laws of the State of Florida, without regard to its conflict of law principles. Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

WAIVER OF CLASS ARBITRATION NOTWITHSTANDING THE OBLIGATION TO ARBITRATE DISPUTES, THE PARTIES AGREE TO ARBITRATE OR LITIGATE SOLELY ON AN INDIVIDUAL BASIS, AND THAT THIS AGREEMENT DOES NOT PERMIT CLASS ARBITRATION OR ANY CLAIMS BROUGHT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ARBITRATION PROCEEDING, LITIGATION, OR ANY OTHER PROCEEDING. THE ARBITRAL TRIBUNAL OR COURT MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

Changes to Our Privacy Policy
